Perhaps the most
emotionally charged aspect of a divorce case is the custody of the
children. The most common question
asked of our office is “Will I get my children?”
You should be aware
that
in many California counties mediation is mandatory.
The mediator meets with the parents outside of
the presence of
the attorneys and assists them in arriving at a resolution. If a resolution is reached, then the parties’
agreement becomes the court’s order. Maintaining
“status quo” is favored. “Best interest”
of the children is the primary
concern for the Court.
Absent conclusion
through
the mediation process litigation remains the state mandated ultimate
forum for
resolution.
